FI3LD Early Access Terms of Service

These Early Access Terms govern access to and use of FI3LD at fi3ldalpha.com and related services during FI3LD's early-access period.
Who Operates FI3LD
"FI3LD", "we", "us", and "our" mean Diego Mínguez de León, an individual based in L'Alfàs del Pi, Alicante, Spain, unless FI3LD is later operated by a company or other legal entity. If that happens, FI3LD may update or assign these Terms to reflect the new operator.

What FI3LD Is
FI3LD is an early-access workspace for writing, files, maps, windows, publishing, and collaboration. The app may include text files, folders, code files, asset files, uploads, linked files, share links, public files, version history, bug reports, and payments.
FI3LD is still being built. Features may change, break, disappear, or work differently later.
Acceptance
By creating an account, signing in, using FI3LD, or continuing to use FI3LD after these Terms are posted, you agree to these Terms and to the FI3LD Early Access Privacy Policy.
If you use FI3LD for an organization, you represent that you have authority to accept these Terms for that organization. FI3LD does not currently have a team-specific account model.
Eligibility
FI3LD is not intended for children under 14. If you are a minor where you live, you may use FI3LD only with permission from a parent or legal guardian where required by law.
FI3LD is not currently a school-managed education service. Do not use FI3LD as a school, classroom, or child-directed service unless FI3LD separately agrees in writing.
Early Access
FI3LD early access is seat-limited. The first 1,000 approved early-access seats are free. When those free seats are full, FI3LD may require a one-time paid access purchase, close signups, require requests, waitlist users, or change access rules.
FI3LD may limit, suspend, revoke, close, or change access for operational, security, abuse, legal, capacity, or early-access reasons. FI3LD may also disable or limit features while the product is being built.
Direct Early-Access Warning
FI3LD may fail. Bugs, downtime, sync problems, compatibility issues, incomplete features, payment issues, and data loss may occur.
You may use FI3LD for real notes and files, but you should keep independent backups of important content. During early access, FI3LD should not be your only copy of critical files.
Accounts
You are responsible for your account, credentials, devices, and activity under your account. You must provide accurate account information and must not impersonate another person.
FI3LD currently supports email login and Google login when enabled. Third-party login providers have their own terms and privacy policies.
User Content
"User Content" means documents, text, files, uploads, PDFs, images, audio, code, file names, maps, links, comments, published files, bug-report attachments, and other material you create, upload, import, submit, publish, or share in FI3LD.
You keep ownership of your User Content.
You give FI3LD a limited license to host, store, process, copy, display, transmit, sync, back up, version, publish, share, transform, and otherwise use your User Content only as needed to provide, operate, secure, debug, support, and improve FI3LD and to provide features you request.
Sharing And Publishing
FI3LD content is private by default unless you publish, share, invite collaborators, create a public/share link, or otherwise choose to disclose it.
If you publish or share content, other people may view, copy, fork, download, quote, index, or redistribute it depending on the feature and settings. Review content before making it public or shared.
FI3LD may remove or restrict public/shared content if it violates these Terms, creates risk, violates law, infringes rights, or harms FI3LD or others.
Sensitive And Regulated Data
FI3LD is a general note-taking and file workspace. It is not currently designed for protected health information, regulated financial records, payment-card storage, government identity records, classified information, attorney-client systems, or other regulated sensitive workflows unless FI3LD expressly agrees in writing.
You are responsible for what you upload, publish, share, or include in bug reports.
Acceptable Use
You must follow the FI3LD Early Access Acceptable Use Policy. Even if that policy is not published separately, you must not use FI3LD to break the law, violate rights, upload malware, harass others, bypass access controls, attack the service, spam, phish, commit fraud, or expose FI3LD to regulated obligations it has not agreed to support.
Feedback And Bug Reports
You may submit feedback, ideas, bug reports, screenshots, logs, diagnostics, or suggestions. FI3LD may use them without restriction or compensation to debug, secure, operate, and improve the app. This does not give FI3LD ownership of your private User Content.
Early access has no confidentiality requirement. You may talk publicly about FI3LD unless a separate written agreement says otherwise.
Payments And Donations
FI3LD offers paid early access and optional donations through Stripe. During the current early-access plan, the first 1,000 approved seats are free. After those free seats are taken, app access requires a one-time payment of USD $20 unless FI3LD grants or restores access separately.
Donations are optional and separate from app access. Users with free access and users with paid access may donate. Donations are public by default and may be shown in a public Top Donations list with the donor display name and exact donation amount. Users may choose to donate privately; private donations are not shown in that public list.
One-time early-access payments and donations are generally non-refundable except where required by law or where FI3LD decides otherwise. If Stripe records a refund, chargeback, dispute, payment reversal, or similar payment failure for a paid access purchase, FI3LD may revoke the paid access tied to that purchase. If Stripe records a refund or dispute for a donation, FI3LD may remove or reduce that donation in public donation totals and public donor lists. Nothing in this section limits mandatory consumer rights that apply under law.
Deletion And Retention
FI3LD does not yet provide a complete self-serve account deletion or export flow. You may contact contact@fi3ldalpha.com for deletion, export, or account help. During early access, deletion and export requests may require manual handling.
FI3LD may retain data where needed for backups, recovery, security, legal compliance, disputes, public/published copies, collaborator copies, version history, or service operation.
Third-Party Services
FI3LD depends on Supabase for backend services, Vercel for hosting, PostHog for bug-report diagnostics and product debugging evidence, and Stripe for payments and donations. Third-party services have their own terms and privacy policies.
FI3LD Intellectual Property
FI3LD, including its software, design, branding, marks, and service content, is owned by FI3LD or its licensors and is protected by intellectual property laws. These Terms do not grant you ownership of FI3LD software or branding.

Disclaimers
FI3LD is provided "as is" and "as available." To the maximum extent allowed by law, FI3LD disclaims warranties of merchantability, fitness for a particular purpose, non-infringement, availability, security, accuracy, and error-free operation.
We do not guarantee that FI3LD will be uninterrupted, secure, bug-free, compatible with every device, or that content will never be lost. Some jurisdictions do not allow certain disclaimers.
Limitation Of Liability
To the maximum extent allowed by law, FI3LD and its operator will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, loss of profits, loss of data, loss of goodwill, business interruption, user content, third-party services, downtime, security incidents, payment issues, or inability to use FI3LD.
FI3LD's total liability for claims relating to the service will be limited to the greater of the amount you paid FI3LD in the 12 months before the event giving rise to the claim or EUR 100, unless law requires otherwise.
Indemnity
If allowed by applicable law, you agree to defend, indemnify, and hold FI3LD and its operator harmless from claims, damages, liabilities, losses, and expenses arising from your User Content, published/shared content, use of FI3LD, violation of these Terms, or violation of law or third-party rights.
This section may not apply to consumers where prohibited by law.
Changes
FI3LD may change these Terms as the product evolves. If changes are material, FI3LD will provide notice where appropriate. Continued use after updated Terms become effective means you accept the updated Terms.
Governing Law And Disputes
These Terms are governed by the laws of Spain, except that mandatory consumer protection laws in your country or region may still apply.
